Screening Reports

What is a Screening Report?

Screening reports are advisory reports provided at an early stage in a potential claim. These preliminary, pre-litigation reports are shorter and more focused, making them efficient and more cost-effective by: 

  • Providing an early indication of case strength for funding and strategy decisions

  • Providing an early, informal opinion before committing to the cost of a full expert report​

  • Preventing unnecessary full expert instructions in weak cases

  • Helping build a clear, focused plan for further evidence gathering and expert involvement

Screening reports are not full breach of duty and causation reports and are not CPR Part 35 compliant. Instead, they provide a cost-effective way to decide if a case should proceed to full expert instruction, helping solicitors and clients manage time and resources efficiently.

The purpose of a Screening Report is to review the available evidence and give an initial view on whether there appears to be merit in pursuing the case further.​ All Screening reports are prepared to ensure independence, objectivity, and impartiality. 

What's Included in the Report?

Our Screening reports are charged on a fixed fee and typically cover:

Review of the key medical records, witness statements, and supporting evidence provided

An outline of key strengths, weaknesses, or uncertainties in the case

Recommendation of next steps, such as commissioning a full CPR Part 35 compliant Breach of Duty and Causation report or obtaining additional documentation

Application of relevant legal tests – e.g. Bolam and Bolitho principles, Hunter v Hanley or the 'Dunne' principles

A preliminary, short, focused written report, outlining any potential breach of duty and any possible links between the alleged breach and the outcome (causation)

This estimation will be dependent on the volume of records, the number of allegations that need to be addressed, and the general complexity of the case.​​ The fixed fee is set by the individual expert and reflects their specific area of expertise, the length of their clinical career, and their level of experience in preparing expert witness reports.​
