Criminal Reports

What is a Breach of Duty and Causation Report?

Criminal reports are prepared by independent expert witnesses for use in criminal proceedings. They provide an impartial, evidence-based opinion on clinical or medical matters relevant to the case, such as the standard of care provided, the cause of injury, or the likely sequence of medical events.

Our Criminal reports are CrimPR compliant, meaning they are produced in accordance with the legal requirements for expert evidence. Each report is independent, clearly reasoned, and contains the necessary declaration of truth.

Criminal Reports often play a crucial role in determining the outcome of serious cases. They can help clarify complex medical issues for the court, confirm or challenge allegations of negligence or misconduct and establish the medical facts that underpin legal arguments in criminal proceedings.

Criminal Reports are required in cases including; allegations of gross negligence manslaughter, deaths or adverse outcomes in medical or custodial settings, fitness to plead or fitness for detention assessments and cases involving alleged breaches of professional duty with criminal implications.

What's Included in the Report?

Our Criminal reports are charged on an hourly basis and typically cover:

A review of all available evidence, including medical records, witness statements, incident reports, and forensic evidence where applicable

Analysis of the facts against relevant clinical and professional standards, including guidance from regulatory bodies and national best practice standards

Adherence to CrimPR Part 19

Reasonable amendments following review by instructing solicitors or counsel

A clear, balanced opinion on the medical issues in question, addressing:

  • Whether the actions taken were reasonable in the circumstances

  • The cause and mechanism of injury or harm

  • Any link between the alleged breach and the outcome

Fees You Can Rely On

We always provide a fee estimate, so there are no surprises. This estimation will be dependent on the volume of records, the number of allegations that need to be addressed, and the general complexity of the case. The hourly rate is set by the individual expert and reflects their specific area of expertise, the length of their clinical career, and their level of experience in preparing expert witness reports.
